Billing & Payment Terms

Subscriptions are billed in advance on a monthly or annual basis. Payment is due upon invoice issuance. We accept major credit cards and wire transfers for enterprise customers. All fees are non-refundable except as required by law.

Usage-Based Charges

Certain features incur additional charges based on usage beyond your plan's included limits. You will be billed monthly for overage charges. You can monitor your usage through your account dashboard.

Late Payments & Suspension

Failure to pay fees when due may result in service suspension after a 7-day grace period. We reserve the right to charge interest on overdue amounts at the rate of 1.5% per month or the maximum allowed by law, whichever is less.

Cancellation & Refunds

You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

Liability Cap

Our total liability for all claims related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater. Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

You agree to indemnify and hold harmless Booking Node from any claims, damages, losses, and expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of others.

Data Processing & Privacy

Your use of the Service is also governed by our Privacy Policy. For customers processing personal data, we offer a Data Processing Addendum (DPA) that outlines our roles and responsibilities as data processors.

Service Level Agreement (SLA)

We commit to 99.9% uptime for paid plans. If we fail to meet this commitment, you may be eligible for service credits as outlined in our SLA document, available upon request for enterprise customers.

Confidentiality

Both parties agree to keep confidential any proprietary information disclosed during the relationship. This obligation survives termination of the agreement. API credentials and usage patterns are considered confidential.

Termination

Either party may terminate this agreement at any time. We may suspend or terminate your access immediately for violations of these Terms, non-payment, or if required by law. Upon termination, you must cease using the Service and may request data export within 30 days.

Dispute Resolution

Any disputes arising from these Terms shall first be attempted to be resolved through good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Governing Law

These Terms are governed by the laws of the State of California, USA, without regard to conflict of law provisions. Any legal action related to these Terms must be brought in the state or federal courts located in San Francisco, California.

Force Majeure

We shall not be liable for any failure to perform due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
